Please read these Terms of Service ("Terms") carefully before using the AdWasteFix website at https://adwastefix.com or the AdWasteFix SaaS platform (the "Service"), operated by AdWasteFix ("we", "us", "our").

By creating an account or using the Service in any way you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into a binding contract to use the Service. By using the Service you represent and warrant that you meet these requirements.

2. Account Registration

• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately at legal@adwastefix.com if you suspect unauthorised access to your account.
• One person or legal entity may not maintain more than one free account.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Submit URLs or content that infringes any third-party intellectual property rights.
• Attempt to gain unauthorised access to any part of the Service or its infrastructure.
• Use automated scripts or bots to access the Service in excess of rate limits.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Resell or sub-license the Service without explicit written permission.
• Use the Service to store or transmit malicious code, viruses, or harmful data.
• Interfere with or disrupt the integrity or performance of the Service.
• Impersonate any person or entity, or falsely claim affiliation with any person or entity.

The Service uses artificial intelligence to generate audit reports and fix recommendations. AI outputs are provided for informational purposes only and do not constitute professional marketing, legal, or financial advice. You are solely responsible for evaluating and implementing any recommendations. AdWasteFix makes no warranty that AI-generated content is accurate, complete, or fit for a particular purpose.

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference.

8. Third-Party Services

The Service integrates with third-party services (Stripe, Google, OpenAI, Anthropic, Resend, Vercel, Cloudflare). Your use of those services is subject to their respective terms and privacy policies. AdWasteFix is not responsible for the acts or omissions of any third-party service provider.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

ESTIMATED RECOVERY FIGURES SHOWN IN AUDIT REPORTS ARE ILLUSTRATIVE PROJECTIONS BASED ON INDUSTRY BENCHMARKS AND ARE NOT GUARANTEES OF ACTUAL RESULTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ADWASTEFIX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ADWASTEFIX IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $100.

11. Indemnification

You agree to indemnify, defend, and hold harmless AdWasteFix and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party right.

12. Termination

We reserve the right to suspend or terminate your account, with or without notice, if we determine that you have violated these Terms or if required by law. Upon termination, your right to use the Service ceases immediately. Sections 5, 9, 10, 11, and 13 survive termination.

13. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any dispute arising from these Terms shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the rules of the London Court of International Arbitration (LCIA), except that either party may seek injunctive relief in any court of competent jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or via a prominent notice in the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
